Last week, after losing their supermajority in the November election, North Carolina Republicans made the heartbreaking decision to push through a last-minute override of Governor Cooper’s veto of HB 10 – an unconstitutional attack on our immigrant neighbors intended to further stoke fear and division within local communities.

We at RCP, our many partner organizations, and countless neighbors across the state are already mobilizing to protect one another in the face of this latest attack. One of the most important ways we can protect ourselves and each other is to be clear on our rights. 

  • HB10 goes into effect until December 1, 2024 -it does not apply until then
  • This law DOES NOT require police officers to ask about immigration status when they stop folks on the street, nor does it give them the right to racially profile vulnerable communities Members. If asked about your immigrant status by a police officer, you have the right to remain silent.
  • Once enacted, the law will require Sheriffs to contact ICE if they are unable to determine the legal status of a person charged (not convicted) with some felony offenses, 50B violations, and certain A1 misdemeanors
